General Terms and Conditions of Sale (GTCS) - AvenueMac

By placing an order and accepting these terms, you agree that the following general terms and conditions govern your purchase of parts and repair tools for the repair of computers and other electronic products from AvenueMac.
AvenueMac, located at 78 Avenue des Champs-Élysées, Bureau 562, 75008 Paris, FRANCE, can be reached by phone on 01 84 80 09 38 or by email at contact@avenue-mac.com.
The following common terms are defined below and shall have the following meanings:
“Business Customer” means a person who purchases one or more products from AvenueMac in the course of their commercial, industrial, craft or professional activity, whether acting personally or through another person acting in the name or on behalf of the business.
“Consumer Customer” means a person who purchases one or more products from AvenueMac and who is not a Business Customer.
“AvenueMac Product” means new parts or refurbished parts (“Refurbished Parts”). Refurbished Parts have been tested and have met AvenueMac’s functional requirements. Consequently, Refurbished Parts are equivalent to new parts in terms of performance and reliability.
“AvenueMac Tools” means the tools, equipment and related materials purchased in our shop for the purpose of carrying out a repair on a device.

1. USE OF AVENUEMAC PRODUCTS
You purchase one or more Products from AvenueMac for use in the repair of a specific computer (which we will call the “repaired computer”). In addition, AvenueMac may make tools available to you for rental. The general terms and conditions of this rental are set out in the general terms and conditions of rental, which you will find below.
You agree to use AvenueMac Products to repair the repaired computer in a manner consistent with these general terms and conditions. If you are a Consumer Customer, AvenueMac Products are intended to be used for the repair for which they were purchased and may not be resold or otherwise transferred. For certain products, AvenueMac recommends the use of additional equipment and/or tools (such as gloves and tweezers).
Before carrying out any repair, you acknowledge and agree that: (1) you will have read, become familiar with and understood all the Service Documentation associated with any repair to be carried out on each computer, including, without limitation, the process steps, tools and materials required for the repair; (2) you will have access to the tools, materials and workspace required for the repair; (3) you are comfortable with and capable of carrying out the repair; and (4) you may lose some or all of your device’s functionality during the repair, including during any necessary system configuration after the repair.
2. DATA LOSS
We understand that user data (including photos, contacts and files of all types) is precious. Data loss during a repair is always possible, and in some cases data may be erased or unrecoverable. You agree that it is your sole responsibility to back up all existing data, software and/or programs on your computer before carrying out a repair. AvenueMac shall not be liable for the following: (1) any loss, recovery or compromise of data, software or programs; (2) any inability to use your computer resulting from a repair carried out using an AvenueMac product; or (3) any form of temporary or permanent damage to your computer resulting from a repair carried out using an AvenueMac product, unless such loss or damage is caused by a defective AvenueMac product.
3. ORDERS, ORDER ACKNOWLEDGEMENT AND ORDER ACCEPTANCE
To order products from the AvenueMac shop, you can visit the Store website at https://avenue-mac.com/. Then simply add the products you want to your cart, confirm your order (using the payment method of your choice) and have your items shipped to yourself or to a person you designate.
You will have the opportunity to check your order, including information about the products ordered, the price and the shipping costs, before confirming it. Once you have placed your order, we will provide you with an online order number.
After receiving your order, we will send you a confirmation email, in most cases within one business day. The order confirmation email does not mean that we accept your order; we are simply confirming that we have received it. Once we have processed your order and prepared it for shipping, we will send you an email stating that we have accepted your order, which will include the shipping details (the “shipping notification email”). We reserve the right to refuse your order before the shipping notification email is sent, in particular if the requested product is not available. We will inform you of the reasons for this refusal and will not charge you for this order. To make sure your product is available, we do not accept your order until we have prepared your product for shipping. In most cases, this takes one week for items in stock. For items that are not in stock, you will receive the shipping notification email when the item is available and ready to be shipped, but in no event later than the shipping time indicated to you when you ordered. Once we have sent the shipping notification email and you have received it, a contract is concluded between AvenueMac and you. Information about your order will be processed in accordance with our privacy policy, available below.
The shipping notification email will specify the price of the AvenueMac Product(s). All prices shown include value added tax (“VAT”). If the VAT rate changes between the order confirmation email and the shipping notification email, we will adjust the VAT rate you pay, unless you have already paid the full amount before the change in VAT rate takes effect.
4. SHIPPING AND DELIVERY
Shipping costs may or may not be charged depending on the destination. Orders containing several items will be shipped in a single shipment when all the products in your order are in stock, and no later than 7 days from the day after the date of the shipping notification email.
Insofar as AvenueMac handles the shipping of the products you buy from the shop, the risk of loss of or damage to AvenueMac products passes to you when you, or a person designated by you, take physical possession of the AvenueMac Products. Title to AvenueMac products passes to you when you, or a person designated by you, take physical possession of the AvenueMac products. In the event of a delivery problem, contact AvenueMac to find a solution.
5. SAFETY AND DISPOSAL OF LITHIUM-ION BATTERIES
Battery safety is a very important concern when repairing a device with a built-in lithium-ion battery. Misuse or mishandling of lithium-ion batteries can result in fire, injury or death. For your safety, if you are not comfortable carrying out a battery replacement or other repairs, seek the help of a technician with the necessary knowledge and experience. Improper battery replacement, incorrect handling of parts or failure to follow instructions may also result in data loss or damage to your device, its parts or your other property. Read all the battery safety instructions in the manufacturer’s service documentation and follow the workspace and battery handling guidelines before starting a repair. If the battery is dented, punctured or otherwise damaged, or if the battery cannot be removed from the device, stop the repair, consult the battery safety instructions in the manufacturer’s service documentation, reassemble the device and stop using it.
Lithium-ion batteries are hazardous waste. Used lithium-ion batteries must be disposed of separately from household waste and in accordance with local environmental laws and guidelines, for example by taking them to a collection point designated by the local authorities.
6. RIGHT OF WITHDRAWAL AND RETURNS
You have the right to cancel your order and return an AvenueMac product for any reason, or without giving any reason, within 30 days of the day on which you, or a person designated by you, took physical possession of the AvenueMac product.
You can cancel your order at any time after receiving the order confirmation email, but before receiving the shipping notification email. Once you have received the shipping notification email, you must follow the return procedure described below.
Returns must be made within 30 days of the day on which you, or a person designated by you, took possession of the AvenueMac product in accordance with article 4 above (the “Return Period”). AvenueMac only accepts returns of products purchased from the shop that are returned in new, unused and unaltered condition and in their original packaging. To initiate a return, contact us at any time during the Return Period to let us know that you intend to return the product or cancel the order.
Please note that tools that have been used are not eligible for return. This exclusion applies as soon as the tools have been used.
You can inform us of your intention to cancel your order or return a product by filling in the request form that you will find [here].
Once you have informed us of your intention to return the AvenueMac product, send the product back to us with the return slip, the original packaging and the included accessories (if any). You have an additional 14 days after indicating your intention to return the AvenueMac Product(s). If the returned AvenueMac product is damaged, we may deduct the reduced value of the AvenueMac product from the amount of your refund.
All returned AvenueMac Products are subject to our inspection and approval before a refund is made. For any returned AvenueMac product that we agree to refund in accordance with these terms, we will issue a refund equal to the purchase price and applicable taxes originally paid for the returned AvenueMac product and the delivery costs (except for delivery costs exceeding the most basic delivery costs we offered you at the time of purchase) to the original payment method used to make the purchase. Payment will be made no later than 14 days from our receipt of the returned AvenueMac product or, if earlier, 14 days from our receipt of proof from you that you have sent the returned AvenueMac Products. The time it takes for the refund to appear on your account varies depending on the payment method used and the credit card issuer. Except where the AvenueMac product is incorrect or defective, the delivery costs for returning the AvenueMac product to us are at your expense.
If you receive an AvenueMac product that you did not order, or if an AvenueMac product is missing from your order, contact AvenueMac as soon as possible after receiving the shipment and we will help you resolve the problem. Describe the incorrect or missing AvenueMac Product(s) and attach photos if possible.
Once you have received the AvenueMac Product(s), we ask you to:

  1. check as soon as possible that the AvenueMac Product(s) show no visible signs of damage caused by transport; and
  2. if you discover visible signs of shipping damage, inform AvenueMac promptly within a reasonable time.

Nothing in this return policy affects any rights or remedies you may have under statutory warranties, applicable manufacturer warranties or commercial warranties, including your rights to return defective products during the warranty period of the AvenueMac Limited Warranty for AvenueMac Products (French commercial warranty).
7. AVENUEMAC LIMITED WARRANTY
AvenueMac Products are covered by the French commercial warranty which, subject to certain limitations and exceptions described therein, provides remedies for AvenueMac Products that have defects in materials or workmanship during the warranty period (which, for used products, is 180 days from the date of original retail purchase, and for new products, is 1 year from the original retail purchase). If you are a Consumer Customer, you may also be entitled to a repair or replacement under consumer law outside the warranty period. Damage caused to the repaired computer by your repair is not covered by the standard AvenueMac hardware warranty applicable to the repaired computer, nor by any other warranty. Such damage may be subject to out-of-warranty repair fees or may make the repaired computer ineligible for repair. AvenueMac does not provide technical support for repairs.
8. CONSUMER RIGHTS
If you are a Consumer Customer, the AvenueMac Limited Warranty (French commercial warranty) is separate from and in addition to the statutory warranties provided by French consumer law, and you may have free remedies against AvenueMac in the event of a lack of conformity, in addition to the AvenueMac Limited Warranty for AvenueMac Products (French commercial warranty). AvenueMac may process data relating to any consumer claim in accordance with its privacy policy.
Consumer Customers benefit, in all cases, from the statutory warranty of conformity and the statutory warranty against hidden defects under French consumer law. To exercise your consumer rights, contact us using the contact details provided at the beginning of these terms.
9. PAYMENTS
Payments for AvenueMac products can be made either by credit card or by bank transfer.
We reserve the right to verify the identity of the cardholder. To check that your credit or debit card is not being used without your consent, we will validate the name, address and other personal information you provide to us during the ordering process against the information held by the card issuer and the payment integrator. By accepting these general terms and conditions, you consent to such checks being carried out. All cardholder information is secured by a payment gateway, and credit card information is not stored on the AvenueMac website.
If you pay by credit card, when you place your order we may block an amount equal to the total amount of the order on your credit card. If we do not receive authorisation from your credit card issuer, we will inform you so that you can provide us with another payment method. Your credit card will be charged as soon as we have accepted your order.
10. BUSINESS PURCHASES
If you are a Business Customer, you will not benefit from the statutory consumer rights provided by French law.
If you are a Business Customer, except for liability arising from our wilful misconduct or gross negligence and liability that cannot legally be limited, our total liability to you will not exceed the total cost of your order.
11. GENERAL
If a court decides that any provision of these terms is unlawful, the other provisions of these terms will remain in force.
The laws of the country in which you ordered the service or product govern this contract, unless otherwise stated below.
For customers who are not considered consumers, these terms are governed by and construed in accordance with the laws of France, and all claims must be brought before the French courts.
Consumer information on online dispute resolution (in accordance with Regulation (EU) No 524/2013): if you are a consumer and have entered into this contract with AvenueMac, you may use an online out-of-court dispute resolution procedure to settle disputes. The European Commission has set up an online dispute resolution platform, available at http://ec.europa.eu/consumers/odr/.
Consumer information on out-of-court dispute settlement for customers: AvenueMac is not obliged to, and does not intend to, take part in an alternative dispute resolution procedure.
These terms constitute the entire agreement between you and us. These terms may only be amended if you and we agree in writing. If you fail to comply with these terms and we do not take action immediately, this will not prevent us from taking action against you at a later date and does not mean that we accept or agree that you are not required to comply with these terms.

Commercial warranty agreement - AvenueMac Warranty

For AvenueMac parts and for tools purchased in France from the AvenueMac shop only. This Warranty does not affect or limit your right to cancel your order or return an AvenueMac product in accordance with AvenueMac’s French general terms and conditions.
IMPORTANT: BY USING AN AVENUEMAC PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THE AVENUEMAC LIMITED WARRANTY (THE “WARRANTY”).
READ THIS WARRANTY CAREFULLY; IT INCLUDES CERTAIN LIMITATIONS AND EXCEPTIONS, AS WELL AS INSTRUCTIONS ON HOW TO MAKE A WARRANTY CLAIM (“CLAIM”).
THIS WARRANTY DOES NOT APPLY TO THE PRODUCT YOU ARE ATTEMPTING TO REPAIR (THE “REPAIRED AVENUEMAC PRODUCT”), BUT ONLY TO THE AVENUEMAC PRODUCT USED TO CARRY OUT THE REPAIR. IN ADDITION, AVENUEMAC DOES NOT PROVIDE TECHNICAL SUPPORT FOR THE PRODUCTS OR FOR THEIR USE IN REPAIRS.
APPLICATION OF CONSUMER LAW UNDER THIS WARRANTY
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND IS SEPARATE FROM AND IN ADDITION TO THE CONSUMER RIGHTS PROVIDED BY FRENCH CONSUMER LAW. THIS WARRANTY DOES NOT AFFECT YOUR RIGHTS UNDER FRENCH CONSUMER LAW. AVENUEMAC DOES NOT EXCLUDE, LIMIT OR SUSPEND ANY OTHER RIGHTS YOU MAY HAVE UNDER FRENCH CONSUMER LAW, INCLUDING THOSE THAT MAY ARISE FROM THE NON-CONFORMITY OF A SALES CONTRACT.
In accordance with AvenueMac’s general terms and conditions, consumers benefit from the statutory warranty of conformity and the statutory warranty against hidden defects under French consumer law. This Warranty is without prejudice to these statutory rights.
To exercise your consumer rights, contact us using the contact details given in AvenueMac’s general terms and conditions.
For the purposes of the disclaimer below, the term “consumer” means “you” and the term “professional” or “seller” means “the entity selling under AvenueMac’s French general terms and conditions”.

The consumer has a period which, for used products, is 180 days from the date of original retail purchase and, for new products, is 1 year from the original retail purchase, to obtain the application of the statutory warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service over a period of more than two years, the statutory warranty applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory warranty of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests the repair of the goods but the seller imposes a replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund upon return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In this case, the consumer is not required to request the repair or replacement of the goods beforehand.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until the restored goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the statutory warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

AvenueMac’s published guidelines include, without limitation, the information contained in technical specifications, user manuals and service communications. An AvenueMac Product with defects in materials or workmanship that is covered by this Warranty is called a “Defective Product”.
Any replacement AvenueMac Product provided to you under this Warranty is warranted for the remaining warranty period of the originally purchased AvenueMac Product, or for thirty (30) days from the date of delivery, whichever is longer, or for any additional period that may be required by applicable law.
This Warranty applies only to the original purchaser who bought the Product from Avenue-Mac.com and is only transferable or applicable to any subsequent consumer who acquired the covered product from another consumer, in accordance with article L217-29 of the French Consumer Code.
WHAT DOES THIS WARRANTY COVER?
AvenueMac parts: AvenueMac warrants that the AvenueMac Part is free from defects in materials and workmanship when correctly installed and used normally in accordance with the manufacturer’s published guidelines.
WHAT DOES THIS WARRANTY NOT COVER?
This Warranty does not apply to the following, and AvenueMac will not be liable under this Warranty for:

  • any damage caused by the use of the AvenueMac Product to attempt or carry out a repair;
  • any damage caused by the use of a third-party component or product that does not meet the specifications of the manufacturer’s published guidelines;
  • any AvenueMac Product that has been repaired or modified to alter its functionality or capability without AvenueMac’s written permission;
  • consumable parts, such as adhesives, unless the failure of the consumable is due to a defect in materials or workmanship;
  • any AvenueMac Product that has been subject to misuse, negligence, alteration, modification or any other internal or external damage;
  • any AvenueMac Product that has been subject to improper storage, transport, installation, operation, handling or use, including use in conditions for which the AvenueMac Product was not designed, use in an unsuitable environment or use contrary to AvenueMac’s published guidelines or to applicable laws or regulations; or
  • any defect caused by normal wear and tear or by the normal use and ageing of the AvenueMac Product.

WHAT REMEDIES ARE AVAILABLE IN THE EVENT OF A BREACH OF WARRANTY?
If, during the Warranty Period of the AvenueMac Product concerned, you submit a Claim for a Defective Product in accordance with the “How to make a Claim?” section of this Warranty, AvenueMac, through its Warranty claims administrator and at its discretion, will:

  • replace the Defective Product with a replacement product with the same characteristics as the original product. We reserve the right to use new and/or refurbished parts to replace the Defective Product, provided that these parts have been tested and have met AvenueMac’s functional requirements, or
  • if no replacement product is available, exchange the Defective Product for a refund of the purchase price.

AvenueMac General Terms of Service

General terms of service
Article 1: General provisions
1.1 The Company
AVENUEMAC is a simplified joint-stock company (SAS) with share capital of €10,000, registered with the Paris Trade and Companies Register under number 883 875 338, whose registered office is at Bureau 562 – 78 avenue des Champs-Élysées – 75008 PARIS.

1.2 Purpose of the repair service
AVENUEMAC specialises in the repair of computer equipment, which it carries out through its own technicians.
AvenueMac works exclusively in its workshop located at AvenueMac
7 Rue du Bigarreau, 68260 Kingersheim. Collection of the faulty device by courier can be arranged anywhere in France.

1.3 General Terms of Service
These General Terms of Service, hereinafter referred to as the “General Terms”, are drawn up by AVENUEMAC.
They define the general contractual terms applicable between AVENUEMAC and its customer in the context of its repair activity.
The Customer declares that they have read them before confirming their service request.

1.4 Amendment of these General Terms
AVENUEMAC reserves the right to amend these General Terms at any time, in particular to comply with any changes in regulations.

Article 2: Description of the repair and setup services
2.1 Repair
For the repair of devices, AVENUEMAC, through its teams, will present a quote to the customer, which the customer must approve before the technician carries out the repair.
Beforehand, we offer simple flat-rate pricing, so that the customer knows the first amount they will have to pay:
Single flat rate including:
• The labour required to repair the faulty device (excluding parts)
up to 1 hour.
• And in addition:
o A detailed quote for repairing the fault with parts
o Each additional quarter of an hour being chargeable
From 16 February 2026, the replaced part (and the associated work) is covered for ninety (90) days from the date of the repair. If the device still benefits from an ongoing commercial warranty, the applicable coverage is whichever expires later between these 90 days and the remaining warranty.

If, during the work, our technician finds that the faulty device is technically unrepairable, or if the quote drawn up by AVENUEMAC’s teams is declined by the customer, our flat rate paid as a deposit remains due in full. In such cases, AVENUEMAC will therefore not make any refund.

Article 3: Consumer protection provisions / Right of withdrawal
3.1 Reminder of the legal texts
The provisions of article L.121-20 of the French Consumer Code are expressly recalled.
Article L.121-20 of the French Consumer Code: The consumer has a period of fourteen clear days to exercise their right of withdrawal without having to give reasons or pay penalties, except, where applicable, for return costs. The consumer may derogate from this period if they are unable to travel and at the same time need to call on an immediate service necessary for their living conditions. In this case, they would continue to exercise their right of withdrawal without having to give reasons or pay penalties. The period mentioned in the previous paragraph runs from receipt for goods or from acceptance of the offer for services. Where the information provided for in article L.121-19 of the French Consumer Code has not been provided, the period for exercising the right of withdrawal is extended to three months. However, where this information is provided within three months of receipt of the goods or acceptance of the offer, it starts the fourteen-day period mentioned in the first paragraph. Where the fourteen-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
Article L.121-20-1 of the French Consumer Code: When the right of withdrawal is exercised, the professional must refund the consumer all sums paid as soon as possible and at the latest within thirty days of the date on which this right was exercised. Beyond that, the sum due automatically bears interest at the legal rate in force. This refund is made by any means of payment. At the professional’s suggestion, the consumer who has exercised their right of withdrawal may, however, opt for another method of refund.
Article L.121-20-2 of the French Consumer Code: Unless the parties have agreed otherwise, the right of withdrawal cannot be exercised for contracts: 1° For the supply of services whose performance has begun, with the consumer’s agreement, before the end of the fourteen clear days period [...]. It is recalled that a consumer is a natural person acting to satisfy their personal needs, unrelated to their professional activity. A legal entity or a natural person acting for professional purposes who accepts the Merchant’s offer does not benefit from the right of withdrawal. It is also recalled that AVENUEMAC and the Customer have not agreed to any derogation from the legal withdrawal procedures.

3.2 Exercising the right of withdrawal
Under the conditions provided for in article L.121-20 of the French Consumer Code, the customer has a withdrawal period of fourteen days from their confirmation of a request for the repair or setup of a given device.
The customer has a right of cancellation for each of their requests.
Any exercise of the right of withdrawal must be made to AVENUEMAC’s Customer Service by:
- Email with delivery receipt to the company email address contact contact@avenue-mac.com specifying the word “Withdrawal” in the subject of the email.
- Registered letter with acknowledgement of receipt to the registered office address specified above.
The customer is expressly warned, and their attention is specifically drawn to the fact, that exercising this right by email may result in the request not being processed if the message is incorrectly addressed.

Article 4: Price and payment
4.1 Price
The amount of the various flat rates is stated on the website www.avenue-mac.com. They are stated in euros including all taxes, and may change without notice.
For each job, any overrun of the one-hour time slot included in the flat rate will be charged €49.90 incl. VAT.
All sums paid by customers are definitively retained by AVENUEMAC with no possibility of reduction, even if new flat-rate terms are subsequently offered on more advantageous financial terms for the customer.

4.2 Payment methods
Payment for AVENUEMAC’s service is made directly to our technician at the end of the work, by bank card (Visa, CB or Mastercard) on site or online via a payment link.

Article 5: Exemption from liability and force majeure
In accordance with article L.121-20-3 of the French Consumer Code, AVENUEMAC cannot be held liable in the event of non-performance or improper performance of these terms attributable to the customer, to the unforeseeable act of any third party to these terms, or to a case of force majeure.

Article 6: Partial invalidity
The nullity, unenforceability or deemed unwritten nature of one or more clauses of the contract shall not automatically render the whole of these terms null and void.

Article 7: Complaints
Any complaint must be sent to AVENUEMAC’s customer service by email with acknowledgement of receipt to the email address contact@avenue-mac.com or by registered letter with acknowledgement of receipt to the address of AVENUEMAC’s registered office mentioned above.

Article 8: Mediation
In accordance with article R.612-1 of the French Consumer Code, the customer may refer the matter free of charge to the Consumer Mediator: Société Médiation Professionnelle – www.mediateur-consommation-smp.fr – 24 rue Albert de Mun – 33000 Bordeaux, for any complaint already submitted in writing to AVENUEMAC’s customer service less than one year ago and not resolved.

Article 9: Applicable law and competent jurisdiction
The General Terms are governed by French law.
Within the limits authorised by French law, in the event of a dispute, express jurisdiction is conferred on the courts within the jurisdiction of the Paris Court of Appeal, notwithstanding multiple defendants or third-party claims

Article 10: Shipping and transport of devices
10.1 Home collection by courier
As part of its remote services, AVENUEMAC offers collection of the faulty device from the address chosen by the customer. This collection is carried out by a courier appointed by AVENUEMAC.
The customer is responsible for securely packing the device before collection. The device must be properly protected in a suitable parcel, ready to be shipped when the courier arrives. No accessories (cable, charger, case, sleeve, keyboard, etc.) should be included, unless expressly requested in advance by our technical department. If unreported accessories are included, AVENUEMAC accepts no liability for their loss or damage.

10.2 Transport insurance conditions
The transport service includes by default insurance of up to €45, included in the price of the collection service.
If the customer wishes to insure the device beyond this amount, two levels of optional insurance are offered:

  • Insurance up to €1,000: €74 surcharge excl. VAT
  • Insurance up to €2,000: €148 surcharge excl. VAT

Any request for additional insurance must be expressly made by the customer before the device is collected by the courier. Once the parcel has been handed over to the carrier, it will no longer be possible to add or change the insurance.

10.3 Liability during transport
AVENUEMAC cannot be held liable for any loss, theft or damage occurring during transport beyond the insured amounts explicitly chosen and confirmed before shipping.

AvenueMac General Rental Terms and Conditions

1. Presentation of the contract

This rental contract establishes that you, as the renter, agree to rent the tools and equipment specified in your rental confirmation, offered by AvenueMac, located at 78 Avenue des Champs-Élysées in Paris, France.

2. Rental period

The rental period, defined as the “Rental Period”, is seven (7) calendar days. This period begins on the date of receipt of the rented equipment, or is deemed to have begun if article 7 applies. If the last day of this period falls on a weekend or public holiday, it is extended to the next working day.

3. Rental terms

1. You are liable for any loss, damage or theft of the rented equipment until it is returned to AvenueMac or to a carrier designated by us. If the equipment is not returned at the end of the rental period, you will be charged for its replacement (including handling fees) or for the necessary repairs, unless the cost of repairs exceeds the replacement value.
2. Any amount due may be charged to your payment method. The amount for items not returned will correspond to the amount confirmed when you ordered. For damaged items, the cost will be determined and communicated later. If the payment fails, you remain liable for this sum, and we will contact you to arrange a new payment.
3. Failure to pay an amount due after a reminder may lead to debt collection proceedings on our part.
4. In the event of loss, theft or damage to the equipment, AvenueMac reserves the right to refuse any future rental.

4. Payment

In addition to the rental cost, an amount may be blocked on your payment method to cover any repair or replacement costs for the equipment. The exact amount will be confirmed when you order. This amount will not be charged if the equipment is returned in good condition and on time. However, the authorisation hold may limit your access to these funds while it is active. If the repair or replacement costs cannot be covered by this hold, they will be deducted from the payment method provided.

5. Delivery and return

- We will arrange delivery of the rented equipment. On receipt, please:
- Immediately inspect the equipment for any transport damage.
- Promptly report any visible transport damage to AvenueMac.
- Specific return instructions will be provided to you. Following these instructions is essential to avoid damage during the return. You will be responsible for organising and packing the equipment for return, in accordance with our instructions, via a carrier approved by AvenueMac.
- By accepting this service, you explicitly consent to AvenueMac starting the service and acknowledge that once the service has begun, you cannot cancel your order or exercise a right of withdrawal.
